Climbing is a fun and challenging sport, but not one without risk of injury. You are and always will be responsible for your own actions while climbing, securing and bouldering.

We have house rules with safety regulations and appeal to your own responsibility. Definitions
1.1. Activity
An activity offered or organized by Neoliet, indoor or outdoor, focused on physical exertion and/or adventurous experience, actions that may be necessary to prepare, support or conclude the activity (instruction or guidance), rental or sale of equipment, the provision of catering, the sale of gift cards, the provision of facilities.
1.2. Guided Activity
An Activity supervised by a Team Neoliet Representative, with or without instruction, education or training.
1.3. Booking
Form of Contract that is reserved in advance with Neoliet by Contractor and entitles Contractor to participate in an Activity and for which additional or specific terms and conditions may apply including, but not limited to, packages for business or education, (vocational) training, courses, events/competitions, children's parties, introductory classes, introductory classes, room rental.
1.4. Contractor
The natural person or legal entity that enters into an Agreement with Neoliet for itself or third parties or uses Neoliet's Activities, facilities, services or materials.
1.5. Participant
Any natural person who participates in or uses an Activity.
1.6. Entrance ticket
Form of contract that entitles a person to participate in or use an Activity and may be subject to additional or specific terms and conditions including, but not limited to, subscriptions, strip cards, day passes, memberships.
1.7. Introductory
Participant who participates in or uses an Activity under the supervision and responsibility of another Participant.
1.8. Neolite
The trade name of Neoliet's sports facilities.
1.9. Neolite Location
The location of Neoliet where the Activity takes place.
1.10. Agreement
Agreement between Neoliet and the Contractor regarding an Activity.
1.11. Force majeure
Abnormal and unforeseeable circumstances independent of the will of the person invoking them, the consequences of which could not be avoided despite all precautions.
1.12. Team Neolite Representative
The person engaged by Neoliet to prepare, supervise, support or instruct the Activity, such as employees, self-employed persons, interns, volunteers, subcontractors or employees of subcontractors.
1.13 Independent Activity.
An Activity that the Participant practices entirely independently, without the guidance and/or supervision of a Team Neoliet Representative. If explanation or instruction is given solely prior to the Independent Activity by a Team Neoliet Representative, this is not considered guidance of the Activity.

1. Definitions

The location of Neoliet where the Activity takes place.

2. Scope
2.1. Neoliet's General Terms and Conditions apply to all Activities, Agreements, Entry Tickets, offers, quotations and other (legal) acts of Neoliet, unless the parties agree otherwise in writing. Applicability of General Terms and Conditions of the Contracting Party or Participant is expressly rejected.
2.2. Acceptance by the Contracting Party or Participant of the applicability of Neoliet's General Terms and Conditions is evidenced by one or more of the following acts: acceptance of a Booking of an Activity, digital and/or written signature, payment of the fee due in respect of an Activity, actual participation in an Activity and use of Neoliet's facilities.
2.3. In case of ambiguity of the regulations (including but not limited to the house rules and safety rules) or how to comply with them, the Participants or Contractor is obliged to contact the staff present before using the facilities.
2.4. Neoliet's offer is non-binding and may be revoked by Neoliet, if necessary, even after acceptance by the Contracting Party, for example due to correction of errors in price calculation or other errors. The revocation by Neoliet must take place as soon as possible, but in any case within 48 hours after the day of acceptance without giving reasons. The Contracting Party shall in that case be entitled to an immediate refund of any monies already paid. Obvious errors and/or mistakes shall never bind Neoliet.
2.5. If the Contractor has entered into an Agreement (also) on behalf of other Participants or a group of Participants, it is the responsibility of the Contractor that all Participants or members of the group strictly comply with the obligations as stated in these General Terms and Conditions, as well as Neoliet's house rules and safety rules, and that all Participants meet all the requirements set for an Activity.
2.6. Neoliet is entitled to unilaterally modify these Neoliet General Terms and Conditions. Neoliet shall inform the contracting party in a timely manner via at least neoliet.nl, social media, at the counter.
Scope
2.1. Neoliet's General Terms and Conditions apply to all Activities, Agreements, Entry Tickets, offers, quotations and other (legal) acts of Neoliet, unless the parties agree otherwise in writing. Applicability of General Terms and Conditions of the Contracting Party or Participant is expressly rejected.

3. Security, house rules and safety rules
3.1. The Participant informs himself in advance of the nature of the Activity and investigates the risks associated with the Activity. The Participant is aware that the Activities offered by Neoliet, are high-risk activities and that human error during Activities can lead to very serious injury.
3.2. The Participant undertakes to be mindful not only of his or her own safety, but also that of others. The Participant agrees to report any unsafe situation, including but not limited to defects in climbing, and bouldering wall or climbing equipment, misconduct or failure to follow the safety rules/house rules of other visitors.
3.3. The Participant is obliged to disclose to Neoliet all facts and circumstances that may affect participation in the Activity. Neoliet may rely entirely on the accuracy of the Participant's communications regarding the Participant's knowledge, skills, experience, physical and mental condition and the presence and validity of any diplomas/certificates/licenses required in relation to an Activity.
3.4. The Participant who uses the Activities undertakes to use the facilities provided only if his/her state of health permits and fitness is sufficient to undertake the Activities offered. The Participant will not participate in an Activity if he has consumed alcohol or drugs, or has taken medications that may affect the Participant's ability. The Participant declares that he can participate in the Activity without endangering himself or others. If in doubt, the doctor should be consulted.
3.5. The Participant is obliged to inform himself of the current house and/or safety rules, safety instructions, pertaining to the Activity or stay at the Neoliet Location each time before the start of each Activity, and he/she is obliged to abide by these rules. These rules are posted in clearly visible places within the Neoliet Location and available at the front desk of the Neoliet Location. The rules are an excerpt from the material offered in courses and trainings. The house and/or safety rules are also published on the Neoliet website. If the rules cannot be found or are not clear to the Participant, he/she shall contact a Team Neoliet Representative of Neoliet for handing and/or explanation of the rules before participating in the Activity. House and/or safety rules may be modified from time to time. The Participant shall ensure before the start of each Activity that the house and/or safety rules have been updated.
3.6. A Participant in a Supervised Activity shall listen attentively to and scrupulously follow all instructions and directions given by the Team Neoliet Representatives.
3.7. Given the risks that may be associated with an Activity and the fact that an Activity is participated in by several Participants at the same time, Neoliet has the right at all times to deny a Participant participation in an Activity if the Team Neoliet Representative is of the opinion that the safety of the Participant, Team Neoliet Representatives or third parties is or threatens to be endangered, or if the physical or mental condition of the Participant is, in Neoliet's opinion, insufficient for (further) participation in the Activity. This decision is at Neoliet's sole discretion and cannot be questioned by the Participant or Contractor.
3.8. Neoliet does not provide alcohol to persons under the age of 18 and/or during an Activity. Upon Participation in an Activity, the client declares that he/she meets this requirement, which places the responsibility on the Participant or the Participant's Legal Representative if the Participant is under the age of 18.
Security, house regulations and safety rules
3.1. The Participant informs himself in advance of the nature of the Activity and investigates the risks associated with the Activity. The Participant is aware that the Activities offered by Neoliet, are high-risk activities and that human error during Activities can lead to very serious injury.

4. Independent activity
4.1. A Participant in an Independent Activity such as independent climbing, is fully aware of the dangers and risks inherent in that Activity and is at all times responsible for his or her own actions during an Activity and own safety. The Participant in an Outdoor Independent Activity is solely responsible for a change or cessation of the Activity due to weather conditions. The safety rules of Article 3 apply without prejudice to participation in an Independent Activity.
4.2. The Participant in an Independent Activity in the field of or related to the sport of climbing (including bouldering, toprope climbing and preclimbing) knows that unexpected situations may always arise, for example, due to the behavior of fellow climbers or other visitors to the Neoliet Location, objects that may fall down from a higher point of the climbing wall, climbing ropes of other climbers hanging in the way, items or persons on the fall mats lying on the ground. This enumeration is not exhaustive. Unexpected events, unpredictable situations and other risks are inherent in the sport of climbing.
4.3. The Participant in an Independent Activity masters the necessary techniques, knows the safety rules and is aware of the risks. He or she climbs independently on a regular basis to maintain knowledge and skills. He or she can demonstrate climbing experience with a Neoliet or NKBV Climbing License, KISS license, equivalent certificate or demonstrated independent climbing skill and experience. The Participant will inform Neoliet fully and truthfully about his/her climbing skills.
4.4. In the event a Participant in an Independent Climbing Activity fuses another climber, the Participant acting as fusee is fully responsible for the safety of the fused person. The fusee is aware of the risks involved in ferrying another climber. He or she will maintain his or her full attention while ferrying and keep a close watch on the other climber at all times and abide by all safety rules.
4.5. A Participant in a contest or competition or event taking place at a Neoliet location, regardless of by whom this contest or competition is organized, is considered a Participant in an Independent Activity for the purposes of these Neoliet General Terms and Conditions, unless it is stipulated per contest (section) or age category that supervision by a Team Neoliet Representative of Neoliet or by Neoliet Contractor approved in advance will take place. In the case of third party supervision, the contest or competition or event shall take place under the responsibility of such Contractor.

4.1. A Participant in an Independent Activity such as independent climbing, is fully aware of the dangers and risks inherent in that Activity and is at all times responsible for his or her own actions during an Activity and own safety. The Participant in an Outdoor Independent Activity is solely responsible for a change or cessation of the Activity due to weather conditions. 5. Registration and access
5.1. Each Participant or Contractor of an Activity must register as a customer of Neoliet prior to initial participation and be aware of and agree to Neoliet's Terms and Conditions and Neoliet's house and safety rules.
5.2. Each Participant or Contracting Party to an Activity at a Neoliet Venue must register for participation in an Activity at the counter or via the electronic entry system at all times. The Participant must be in possession of a valid Entrance Ticket or Booking which he/she can show at all times during his/her visit to the Neoliet Location.
5.3. A pass may be issued to the Participant for the purposes of the (electronic) access control system, registering skills etc. customer data and processing the Entrance Ticket or Booking. If the Participant loses the pass and needs a replacement pass, Neoliet may charge the Participant for the replacement of the pass. The pass holder remains liable at all times for the use and/or misuse of the pass. Use of the pass is personal and non-transferable.
5.4. Neoliet uses various types of Entry Certificates. An Entrance Ticket is valid from the day it is taken out, is entered into for a minimum period which can differ for each type of Entrance Ticket.
5.6. The Contractor is required to provide a continuous direct debit authorization for the purpose of payment for an indefinite term Entry Ticket. Subscription fees are collected in advance. An indefinite term entry ticket, such as a Neoliet membership with direct debit, may be terminated or changed by the Participant, after the expiration of the term and subject to at least one calendar month's notice. Neoliet may terminate this type of entrance ticket without giving reasons, subject to at least two months' notice.
5.7. Failure to participate in the Activities covered by an Entrance Ticket does not entitle you to a refund or any other form of compensation.
5.8. Entry tickets consisting of strips are strictly personal and have limited validity from the date of purchase. Validity period is communicated through the price list. Once the validity of the Strippenkaart has expired, the Contracting Party is no longer entitled to participate in the Activity linked to the Strippenkaart.
5.9. This Article 5 does not apply in case the Participant is part of a group represented by a Contractor and Neoliet has made different arrangements with this Contractor regarding the Participants' access to the Neoliet Location.

6. Opening hours
6.1. Neoliet reserves the right to change or limit the opening hours of the Neoliet locations and.
6.2. On official holidays or on days where major events take place, Neoliet is entitled to close the Neoliet Locations.
6.3. For bookings and by appointment only, Neoliet locations are open outside the communicated opening hours.

Minors
7.1. A Participant who has not yet reached the age of 18 requires the written consent of the parent/legal representative to participate in all Activities. The Participant's parent/legal representative will familiarize themselves with the specific requirements and safety rules applicable within Neoliet at that time per age group and per Activity.
7.2. In the event the minor Participant is part of a group or has been taken as an Introducer represented by a Contractor, the Contractor warrants that such consent has been granted for each minor Participant.
7.3. The Contractor and parent/legal representative are responsible for ensuring that the minor Participant complies with all rules, including but not limited to the house rules and safety rules. These safety rules may be modified/strengthened from time to time.

7. Minors
7.1. A Participant who has not yet reached the age of 18 requires the written consent of the parent/legal representative to participate in all Activities. The Participant's parent/legal representative will familiarize themselves with the specific requirements and safety rules applicable within Neoliet at that time per age group and per Activity.
7.2. In the event the minor Participant is part of a group or has been taken as an Introducer represented by a Contractor, the Contractor warrants that such consent has been granted for each minor Participant.
7.3. The Contractor and parent/legal representative are responsible for ensuring that the minor Participant complies with all rules, including but not limited to the house rules and safety rules. These safety rules may be modified/strengthened from time to time.
Introducer
8.1. Only adult Contractors may bring a Introducer to an Independent Activity. The Introducer is entirely the responsibility and duty of care of the Contractor. The Contractor guarantees that he can accompany the Introducer adequately and safely and that he has all the skills required with regard to accompanying the Introducer to the Independent Activity.
8.2. The Contractor who brings an Introducer to an Independent Activity is responsible for ensuring that the Introducer reports to the front desk and registers with Neoliet.
8
8. Introducer
8.1. Only adult Contractors may bring a Introducer to an Independent Activity. The Introducer is entirely the responsibility and duty of care of the Contractor. The Contractor guarantees that he can accompany the Introducer adequately and safely and that he has all the skills required with regard to accompanying the Introducer to the Independent Activity.
8.2. The Contractor who brings an Introducer to an Independent Activity is responsible for ensuring that the Introducer reports to the front desk and registers with Neoliet.
9. Own guidance and/or instruction
9.1. A Contractor may provide or arrange for its own instruction or supervision of an Activity, provided that the Contractor's own instructor(s) or supervisor(s) have all the skills and/or certifications required for the supervision or instruction of the relevant Activity.
9.2. Neoliet may rely entirely on the accuracy of the Contractor's statements regarding the knowledge, skills and experience of its own instructor or supervisor.
9.3. Neoliet has the right to withdraw permission for its own instruction or supervision at any time if Neoliet's General Terms and Conditions or house and/or safety rules are not observed, or safety is otherwise at issue in Neoliet's judgment.
9.4. Instruction or lessons may be given by persons who are not Team Neoliet Representatives only after prior written permission has been granted by a Neoliet manager. Neoliet is entitled to impose further requirements on the manner in which lessons or instruction are provided and supervised.
9.5. Route building may only take place with sufficient skill, compliance with the route building rules and permission of the manager. Route building may only take place when others are present at the Neoliet Location and is at your own responsibility and risk.
Own guidance and/or instruction
9.1. A Contractor may provide or arrange for its own instruction or supervision of an Activity, provided that the Contractor's own instructor(s) or supervisor(s) have all the skills and/or certifications required for the supervision or instruction of the relevant Activity.
9.2. Neoliet may rely entirely on the accuracy of the Contractor's statements regarding the knowledge, skills and experience of its own instructor or supervisor.
9.3. Neoliet has the right to withdraw permission for its own instruction or supervision at any time if Neoliet's General Terms and Conditions or house and/or safety rules are not observed, or safety is otherwise at issue in Neoliet's judgment.
9.4. Instruction or lessons may be given by persons who are not Team Neoliet Representatives only after prior written permission has been granted by a Neoliet manager. Neoliet is entitled to impose further requirements on the manner in which lessons or instruction are provided and supervised.

Materials
10.1. If the Participant uses materials provided or rented by Neoliet, the Participant shall use these materials only in accordance with the instructions of the Team Neoliet Representatives, and in a manner consistent with the nature of the materials and the purpose for which they were provided. Neoliet is entitled to require a deposit or guarantee from the Participant at the time of provision.
10.2. The Participant shall report any defects in the materials immediately upon receipt. The Participant shall not make any changes to these materials or give these materials to third parties for use. Damage, loss or theft of materials must be reported to Neoliet immediately. The Contractor or Participant shall be liable for damage, loss or theft if such damage, loss or theft is the result of culpable acts or omissions of the Contractor or Participant.
10.3. If the Participant uses proprietary materials, the Participant shall use and maintain such materials only in accordance with the manufacturer's instructions, and in a manner consistent with the nature of the materials and the purpose for which they were provided.
10.4. Improper use of the climbing and bouldering walls is not permitted, including but not limited to removing/modifying knots, ropes or hooks, practicing rope techniques, intentionally damaging the bouldering mats or drop floor.

12.1. Payment terms are set forth in the Agreement and may vary by Activity or form of contract. The payment terms can be found on the site, with a booking or contract form and can be requested from Neoliet.
12.2. At the request of the Contractor, the organizer will make an offer for a mutually agreed upon package. Neoliet is free to temporarily offer arrangements or activities at a reduced rate.
12.3. If claims of Neoliet remain unpaid, the Contracting Party shall receive a first payment reminder, requesting that the outstanding amount be paid within a specified period. Neoliet has the right to charge administration costs at the second payment reminder, with a minimum of EUR 35. If after the second payment reminder, the outstanding amount has not been received in time, Neoliet is free to transfer the claim to a collection agency or bailiff. The associated costs shall be borne by the Contracting Party. Furthermore, Neoliet shall be entitled to charge the statutory interest on the outstanding amount from the date the Contracting Party is in default.
12.4. Claims of Neoliet for which the payment term has expired may be set off at any time against a credit of the Contracting Party with Neoliet or a debt of Neoliet to the Contracting Party.
12.5. Neoliet has the right to annually index and/or adjust all its prices to an increase in costs, charges or levies, including wage costs and costs imposed by or on behalf of the government. Neoliet will announce a price increase in a timely manner.
12.6. If additional costs or charges arise on the part of Neoliet after the agreed price has been fixed as a result of a change in charges and/or levies directly related to the Activity or to the Participant and/or Contracting Party, these may be passed on to the Contracting Party, even after the conclusion of the Agreement.

Interim termination, cancellation or modification
13.1. If, despite prior written reminder, the Contracting Party does not or not properly fulfill its payment obligation, Neoliet has the right to exclude the participation of the Contracting Party (or of the Participants represented by the Contracting Party) in Activities and to terminate the Agreement with immediate effect. In that case, the Contracting Party shall remain bound to pay the agreed price and there shall be no right to a refund of amounts paid. Additional costs incurred by Neoliet in connection with the exclusion shall be borne by the Contracting Party.
13.2. Neoliet may exclude a Participant from (further) participation in the Activity and terminate the Agreement with immediate effect vis-à-vis this Participant if the Participant or Contracting Party fails to comply with the obligations arising from the Agreement, these Neoliet General Terms and Conditions, house and/or safety rules or instructions from Team Neoliet Representatives. Furthermore, Neoliet may exclude a Participant from (further) participation in the Activity if the Participant causes a nuisance to Team Neoliet Representatives or fellow participants, deals with materials and surroundings in an irresponsible manner, misbehaves in Neoliet's opinion or spoils the good atmosphere surrounding the Activity to such an extent that by the standards of reasonableness and fairness Neoliet cannot be required to continue participation in the Activity. In that case, the Contracting Party shall remain bound to pay the agreed price and there shall be no right to a refund of amounts paid.
13.3. In case of an early departure at the initiative of the Contractor or the Participant, the full price for the agreed Activity is due, even in case the departure has a medical reason.
13.4. In the event of Force Majeure, Neoliet has the right to suspend or terminate the performance of the Agreement in whole or in part, without entitling the Contracting Party or a Participant to damages. Neoliet is obliged to inform the Contracting Party of the suspension or dissolution immediately and with reasons. Given the risks that may be inherent in an Activity and the safety of the Participants, it is entirely up to Neoliet to determine whether an Activity can go ahead in the event of Force Majeure.
13.5. Neoliet has the right at any time to suspend or terminate the Agreement if the number of registrations for an Activity is less than the required minimum number without entitling the Contracting Party or a Participant to compensation. Neoliet will notify the Contracting Party within a reasonable time before the start of the Activity.
13.6. In the event of cancellation by the Participant or Contractor, fees may be charged in accordance with the cancellation policy applicable to the Activity in question.
13.7. If Neoliet must proceed to modify the Agreement or Activity due to important circumstances, it shall offer the Contracting Party an equivalent and suitable alternative. If the Contracting Party rejects this alternative, it must immediately inform Neoliet thereof. In the event of rejection, the Contracting Party shall not be obliged to pay the part of the agreed price relating to the parts of the Activity not taken up, if the alternative offered by Neoliet cannot be considered an equivalent and suitable alternative according to the standards of reasonableness and fairness. This article also applies if there is a situation that qualifies as Force Majeure.

Additional costs incurred by Neoliet in connection with the exclusion shall be borne by the Contracting Party.

Neoliet may exclude a Participant from (further) participation in the Activity and terminate the Agreement with immediate effect vis-à-vis this Participant if the Participant or Contracting Party fails to comply with the obligations arising from the Agreement, these Neoliet General Terms and Conditions, house and/or safety rules or instructions from Team Neoliet Representatives. In the event of Force Majeure, Neoliet has the right to suspend or terminate the performance of the Agreement in whole or in part, without entitling the Contracting Party or a Participant to damages. Neoliet is obliged to inform the Contracting Party of the suspension or dissolution immediately and with reasons. Given the risks that may be inherent in an Activity and the safety of the Participants, it is entirely up to Neoliet to determine whether an Activity can go ahead in the event of Force Majeure.
13.5. Neoliet has the right at any time to suspend or terminate the Agreement if the number of registrations for an Activity is less than the required minimum number without entitling the Contracting Party or a Participant to compensation. Neoliet will notify the Contracting Party within a reasonable time before the start of the Activity.
13.6. In the event of cancellation by the Participant or Contractor, fees may be charged in accordance with the cancellation policy applicable to the Activity in question.
13.7. If Neoliet must proceed to modify the Agreement or Activity due to important circumstances, it shall offer the Contracting Party an equivalent and suitable alternative. If the Contracting Party rejects this alternative, it must immediately inform Neoliet thereof. In the event of rejection, the Contracting Party shall not be obliged to pay the part of the agreed price relating to the parts of the Activity not taken up, if the alternative offered by Neoliet cannot be considered an equivalent and suitable alternative according to the standards of reasonableness and fairness. At Neoliet's request, the Participant will fully cooperate with an investigation of the accident or incident by experts, for example the Royal Dutch Climbing and Mountaineering Association.
14.3. Dutch law applies to all Agreements and these General Terms and Conditions of Neoliet.

14.3. Dutch law applies to all Agreements and these General Terms and Conditions of Neoliet.
Liability
15.1. The possibility of accidents or incidents is inherent in the Activities offered by Neoliet. Neoliet has a best-efforts obligation to ensure the safety of Participants as much as possible. From a business perspective, Neoliet can only offer its Activities if it can limit its liability for damages (including property damage and personal injury) in the manner described in this article.
15.2. In the case of Supervised Activity, Neoliet shall be liable for the damages of a Participant or Contractor only if such damages are the direct result of intentional, gross negligence or seriously culpable actions of a Team Neoliet Representative.
15.3. Participation in an Independent Activity is at all times entirely at the Participant's own risk. Neoliet is not liable for damages suffered by the Participant or Contractor during an Independent Activity inside or outside a Neoliet Location, for example as a result of an accident. This also applies to the Participant or Contractor who has not yet reached the age of 18 and, with or without the consent of the parent/legal representative, participates in an Independent Activity, including but not limited to independent toprope and lead climbing.
15.4. Neoliet explicitly excludes liability for damage or injury resulting from a fall caused by a non-existent, insufficient or broken connection between rope and belts or by mistakes of the securing Participants. Damage or injury caused by jumping off or a fall of Participants on a bouldering mat is also excluded.
15.5. Neoliet does not arrange transportation to Activities and is not liable for damages arising from transportation to and from Activities.
15.6. Neoliet's liability for damages suffered by the Participant or Contractor, inside or outside a Neoliet Location, during an Activity supervised by the Contractor's own instructor or supervisor is expressly excluded.
15.7. Neoliet shall not be liable in the event the Participant, Contractor or a third party has performed or omitted to perform acts that contributed to the creation or increase of the damage, which in any case but not exclusively includes a violation, breach or non-performance by the Participant of one or more of the obligations mentioned in articles 3 and 4 of these General Terms and Conditions of Neoliet.
15.8. Neoliet is not liable for damages of or inflicted by Participants that are (in part) the result of an impaired physical condition or health of the Participant if the Participant uses an Activity when the Participant should have realized that this was irresponsible given the physical or mental condition.
15.9. Neoliet is not liable for damage from or inflicted by defects and/or shortcomings of the Participant's own used materials.
15.10. Neoliet shall not be liable for indirect damage or consequential damage of the Participant or Contractor, which shall in any case include loss of profits, - wages, - or sales.
15.11. Neoliet shall not be liable for the Participant's or Contractor's damages if the damages result from a circumstance that qualifies as Force Majeure.
15.12. The Participant or Contractor shall be liable for damages to Neoliet or third parties resulting from an attributable shortcoming or culpable behavior of the Participant or Contractor. The Contractor or Participant is obliged to insure this liability.
15.13. Neoliet shall not be liable for loss, damage or theft of Contractor's or Participant's property.
15.14. Without prejudice to the other limitations of liability, Neoliet shall never be liable for the damages of the minor Participant or Contractor if the Activity takes place under the guidance or supervision of the parent/legal representative of the minor Participant or Contractor.
15.15. Any amounts that the Participant or Contractor has or will receive under any (accident) insurance will be deducted from the payment of damages by Neoliet to the Participant or Contractor.
15.16. Neoliet's liability shall in any case be limited to the amount or amounts claimed under the insurance taken out by Neoliet, plus the excess borne by Neoliet under its liability insurance. If there is no cover under an insurance policy taken out by Neoliet, liability is limited to EUR 10,000 per event, whereby related accidents or incidents will be considered as one accident or incident. The limits in this article do not apply in the event of intentional or deliberate recklessness on the part of Neoliet.
15.17. The Contractor who has entered into an Agreement that relates (in part) to Participants other than the Contractor itself shall indemnify Neoliet against claims by such Participants to the extent that they may result in greater liability for Neoliet than if Neoliet had entered into an Agreement directly with such Participants.

Privacy
16.1. To the extent Personal Data is processed in the course of performing the work, such Personal Data will be processed in a proper and careful manner and in accordance with the Data Protection Act and General Data Protection Regulation.
16.2. Technical and organizational measures will be taken to protect Personal Data against loss or any other form of unlawful processing, taking into account the state of the art and the nature of the processing.

16. Privacy
16.1. To the extent Personal Data is processed in the course of performing the work, such Personal Data will be processed in a proper and careful manner and in accordance with the Data Protection Act and General Data Protection Regulation.
16.2. Technical and organizational measures will be taken to protect Personal Data against loss or any other form of unlawful processing, taking into account the state of the art and the nature of the processing.
